I received a telephone call this afternoon from Ricky Robinson, owner of #101 Rustic Cedar Lane. It had its heated moments, however he has agreed to remove the damaged white fencing from the property.  He will not replace it.  

He has stipulated that he will do this only if we stop calling, emailing and writing him what he describes as "threatening" correspondence. He didn't give me a time frame but I assume it will be fairly soon.

I see that some of the fencing has already been removed by the tenant, Mr. Miles. Thank you!

He also said that someone threatened to sue him over the billboard - however, the billboard is not on his property. Thanks for all you have contributed time, effort, and money so far.

It was agreed that money contributed to the fence fund would be used to supplement the cost of replacing the existing wooden fence on the West side of the entrance to the subdivision and to be put toward a new fence on East side if the current owner cannot be forced to take action. The fence on the West side will be in place by the end of April 2012. 

2. Homeowners present signed the second letter to the current owner of 101 (with the white fence), Ricky Robinson, with copies to the current District 4 representative and to Phil Vandiver and David Vess, both candidates for District 4 commissioner. 

3. Diane Lewis agreed to ask all homeowners who were not present to sign the letter and to consider donating to the fund. Checks should be made out to Dill's Construction.

4. Two homeowners have agreed to contact their respective attorneys to see if there is grounds to send legal notice to Mr. Robinson regarding the condition of the property. And, if so, what the legal fee would be.

5. Carolyn Dietrich and David Dill will ask homeowners  to help contribute labor to the building of the new fence under the direction of David Dill of Dill's Construction. 

6. The next homeowner's meeting will be scheduled for early April.]]></content:encoded>

Dear Mr. Robinson:

Subject: Damaged fencing on property at 101 Rustic Cedar Lane, in unincorporated township of Monrovia in District 4

This is the second time we, the Monrovia homeowners group, are requesting that the severely damaged fencing on the rental property you own at 101 Rustic Cedar Lane be removed or replaced.  Your failure to respond to our correspondence of months ago is disappointing and frustrating.  
At this time, we are sending copies of this letter to Dale Strong, current District 4 Commissioner, as well as Phil Vandiver and David Vess, both candidates for that position in the upcoming election.  We are asking that they will join us in requesting that you take action on this eyesore on your rental property. 
As owners with a vested interest in the overall appearance of Monrovia Hollow, we are vigilant in the upkeep of our individual homes and landscapes. We are currently planning to replace the fencing on the West side of the entrance to the subdivision that was erected by the original builder. 
The value of all the properties in the subdivision is diminished when appearance and condition of any one home is poor. This is especially true of the property at the entrance to the subdivision.

<content:encoded><![CDATA[Good Morning Everyone!  When I was leaving for work this morning there was a black 4 door car sitting on our street.  I didn't recognize the car and it's usually just me, the kids at the bus stop and the chickens out at that time of morning.  I put my community watch hat on and sat in my driveway until the car passed by.  It was a young white man driving.  He went up to the day care and turned around.  I turned around at the gas station and double backed.  He was back on our street and driving very slowly.  I got behind him again and he turned North on Jeff and turned into the first neighborhood on the right.  I think he had a Huntsville Hospital tag (at least it was a custom tag with a "HH") and the letters JTCAH.  I called the sheriff’s office and told them all of this.  It's probably nothing but I wanted to give you a head's up in case you see the car and/or a deputy.  Have a good day!]]></content:encoded>

September 30, 2011 to October 30, 2011, there have been 241 home break-ins. If you see someone backing into a driveway, popping a trunk, and/or wearing a backpack, please call 256-722-7181 and give address and as much description about the vehicle(s) and person(s) as possible.

DO NOT call 911, as this delays information to responding officer(s) and criminal(s) can be in and out in just a few minutes.

The incident started out like a Hollywood environmental film, as the town of Gurley united to oppose a mining operation. Residents formed coalitions, elected a new mayor, overwhelmingly won a town referendum to block a rock quarry.

All along, they worked the levers of system, annexing the land and zoning and to block the quarry. Only, in this case, the company won. And won big.

As Madison County continues to replace cotton fields with cul-de-sacs, the case may serve as a caution for new homeowners in unincorporated areas.

The issue is zoning, or rather the lack of it. In rural Madison County, local officials have no power to steer landfills, gasoline tank farms or junkyards. In the past, rural voters have opposed attempts to grant local zoning authority.

"In most cases you want as little government as possible," said county Commissioner Dale Strong, "but when somebody puts in a chop shop or a strip club next to your home, or somebody fails to cut their grass, that's when somebody wants government to do something."

Gurley residents took matters upon themselves. According to court documents, M&N Materials eight years ago bought 269 acres for $550,000. They later arranged to sell the land to Vulcan Materials for $3.75 million. But Gurley annexed the land and rezoned it for agricultural use, heading off the quarry and prompting M&N to sell the site for $1 million.

A jury found Gurley had effectively condemned the property, which torpedoed the sale price. A jury in February ordered Gurley to pay $2.75 million in damages, plus interest, to M&N Materials. The judge last month tacked on another $1.2 million in lawyers' fees.

That dwarfs the coffers of a town of about 900. Stan Simpson, mayor of Gurley, said the city's annual operating budget is just $750,000. The town is challenging the ruling. Circuit Judge Karen Hall will hold a hearing on Oct. 13 on whether the verdict should be overturned.

"I would think that this might be an issue that would bring us closer to home rule," said county Commissioner Roger Jones.

But in Alabama, only Shelby, Jefferson and Baldwin counties exercise zoning authority in unincorporated areas, said Sonny Brasfield, executive director of the Alabama Association of County Commissions.

He said efforts to change the law arise in growing counties, where a lack of zoning can mean someone raising pigs next to a $300,000 home. "That doesn't compute for someone who has always lived inside a city," said Brasfield. But for some in rural areas "the idea of not being able to raise pigs where they please is unacceptable."

Madison County commissioners favor zoning authority to manage growth, as the county added 58,000 residents over the last decade.

But state Rep. Mac McCutheon, R-Capshaw, said he did not expect the local legislative delegation to support such an idea. "A lot of people move to the rural areas to do what they want to with their property," he said, adding that zoning could be unfair to farmers who predated growing subdivisions.

"It is amazing how when home rule comes up people go ballistic," said Rep. Mike Ball, R- Madison, because they see that as a "backdoor way to tax."

It's not certain whether that would necessarily be the case, as no one is working on any bills for even limited local zoning.

Mayor Simpson in Gurley, asked about the 38,000 people in Monrovia and Harvest, said they may soon look to incorporate or join a nearby city. "I will tell you if something happens that affects them directly, they'll be quick to go," said Simpson. "Because the answer isn't in the county."
